Overview

We know that privacy is an important concern to our customers. We use the information we collect from you for purposes including our own business and marketing purposes, to better understand your preferences, and to respond to your needs and enhance your overall experience on our Website.

This Privacy Policy sets out the basis on which Brother International (NZ) Limited (“Brother”, “our”, “us”, or “we”) collects information from and about you and also the basis on which any such information collected from and about you is dealt with.

Your acceptance of this Privacy Policy

When you provide us with your personal information (whether directly or indirectly), or access:

• Brother’s website at www.brother.co.nz, or any associated website or microsite and any materials downloaded from these websites (collectively referred to as the “Website”); or

• any pages or content established by or associated with Brother on any social media website, online chat forum or page, including but not limited to Facebook, X, Pinterest, TikTok, YouTube, Instagram or LinkedIn,

(together, the Internet Sites and any one of them is an Internet Site),

you are deemed to have read this Privacy Policy and to accept and consent to the provisions of this Privacy Policy without qualification. If you do not accept the terms of this Privacy Policy, you must not:

• enter, access or use any of the Internet Sites; or

• provide us with your personal information.

It is important to note that, if we are unable to collect, use, hold, disclose and otherwise process your personal information in the manner authorised by this Privacy Policy then we may not be able to provide you with the full benefit of our products, services, offers or online and digital platforms.

1. Information Collection

Types of personal information collected

Generally, the types of personal information that we collect from or about you depend on the circumstances in which the information is collected. We have described below examples of the types of personal information that may be collected, however this is not an exhaustive list:

• your name and contact details, including physical and postal address, email address, phone number, and mobile number;

• information relating to the way you use or navigate any of the Internet Sites;

• financial and credit information if you are seeking to obtain finance in relation to the lease of a product;

• bank account information for the purposes of cashback schemes;

• other personal information that we are permitted or required by law to obtain;

• any other information that you choose to provide us in any format or manner which you choose to provide it.

For example, from time to time, we may run contests or other promotions. If you participate, we may request your name, mailing address, email address and other information in order to administer the promotion. When you submit a request, review or comment to our customer service department, we may ask you for your email address.

How we collect your personal information

We collect your personal information in a number of different ways, including, but not limited to, via our Website or other Internet Sites, from you directly or indirectly from third parties, whether in-person, via telephone or email, or paper-based forms. For example:

• Registration

In order to use some areas of this Website, you must first complete a registration form. During registration you are required to give contact information (such as your name and email address). We use this information to contact you about services on our Website in which you have expressed interest. In most instances, it is optional for you to provide information and unique identifiers (such as a username and password), but this is encouraged so we can provide a more personalised experience on our Website.

• Request for Services

You may request services (for example to place an order or request operational assistance) offered by Brother or to provide feedback in a number of ways, such as through our Website, by email, and through external webforms. To fulfil these requests Brother may collect some required information as well as optional information that will help us satisfy your requests.

• Profile

We store information we collect through registrations, cookies (including the Google Analytics cookie), log files, clear gifs, and/or third parties to create a profile of you. A profile is stored information that we keep on you that details your viewing preferences. Consequently, collected information is tied to your personally identifiable information to provide offers and improve the content of the Website for you. This profile is used to tailor your visit to our Website and to direct pertinent marketing promotions to you. Select information from your profile may be shared with third parties, if required to satisfy your request, in accordance with the practices set out under this Privacy Policy. (See "Sharing to Permitted Participants" below.)

• Third Parties

You may request our products or services via Brother partners, such as resellers who may ask you to complete paper forms to arrange installation services. These completed forms are then passed on to us so that we can then collect the information required to provide the requested installation services to you.

• Trade Shows

You may provide personal information (such as your name, contact details, job title, employer, and your product and service preferences) to Brother or a Brother partner at a trade show or other marketing or networking event.

Why we collect personal information

The personal information we collect, hold, use, disclose and otherwise process is collected for the following purposes, however this is not an exhaustive list:

• for our internal business purposes;

• for marketing and promotional purposes;

• to fulfil your requests for information and to provide assistance regarding Brother products and services;

• if you indicate an interest in receiving updates we may periodically send you information about other Brother products and services that we feel may be of interest to you;

• to better understand your preferences, respond to your needs and enhance your overall experience on our Website;

• for considering your eligibility for cashback schemes and paying you if you are eligible under any such cashback scheme;

• for giveaways and competitions;

• for credit rating agencies and debt collection purposes;

• for specific requests which may require assistance from one of our selling partners or service providers.

2. Information Storage

Security

Brother takes all reasonable precautions to protect your information. When you submit information via the Website, your information is processed and stored in highly secure Microsoft Azure Cloud Service systems that conform to strict Information compliance standards.

However, no method of transmission over the internet, or method of electronic storage is 100% secure and we cannot provide an absolute guarantee as to the security of your personal information.

When our registration form asks you to enter personal information (such as name address, phone, e-mail, etc.), that information is encrypted.

3. Information Use and Disclosure

Business Transaction

If Brother or substantially all of its assets are acquired by a third party or otherwise Brother is subject to some form of merger, restructuring or other similar transaction, personal information held by it about its customers will generally be one of the transferred business assets and may be disclosed to a third party involved in that transaction. If such a transaction occurs, then the relevant third party that acquires your personal information may use your personal information in the same way as set out in this Privacy Policy. In the unlikely event of insolvency, personal information may become under the control of an external administrator of Brother who may deal with that information in the manner they elect in connection with that process of external administration.

Special Offers and Updates

You may occasionally receive information on products, services, special deals and/or newsletters. You have the option to not receive these types of communications. Please use the unsubscribe function to unsubscribe from any unwanted communications.

Customer Service

We may communicate with you on a regular basis to provide requested services and in regards to issues relating to your account and we reply via email or phone, in accordance with your wishes.

Sharing to Permitted Recipients

We respect the privacy of your personal information and will take all reasonable steps to keep it strictly confidential. However, we may disclose your personal information to third parties if required in connection with one or more of the purposes of this Privacy Policy. This may include disclosure to the following persons (in each case, a “Permitted Recipient”):

• Brother employees, officers and contractors;

• in specific instances where your request requires action by one of our staff, Partners or Service Providers or selling partners or your IT provider, Brother may forward or provide access to information from your profile. For example, to fulfil a request for quotation, Brother may forward the pertinent details such as contact information, intent to purchase (time, quantity, models, etc.) as well as any special requests;

• for some marketing activities or service related surveys, Brother may enlist the help of a third party provider who may temporarily need to handle your information. For example, during a direct mail campaign, where we may send you announcements per your permission preferences, we may use a third party mailing house. In this case mailing lists are transferred to the third party for the specific purpose of addressing the marketing materials;

• our parent and subsidiary companies or carefully selected third parties who support our business and marketing operations;

• third parties that require the information for law enforcement or to prevent a serious threat to public safety.

Please note that we do not sell or make your information available to other companies who want to tell you about their products, without your consent.

Disclosure of Personal Information Offshore

Some of the Permitted Recipients to whom we disclose personal information may be located outside of New Zealand. We may disclose personal information to Permitted Recipients that may be based offshore (for example, by making customer relationship management systems accessible to relevant manufacturers and/or distributors as the case may be). In addition, our Internet Sites and systems may also be based on servers located outside of New Zealand. Please note that the privacy laws of countries outside of New Zealand may not be as comprehensive as the laws of New Zealand.

If a Permitted Recipient is in a jurisdiction outside of New Zealand, the information held by that Permitted Recipient may be subject to that jurisdiction, including access requests from government, courts or law enforcement in that jurisdiction. If we disclose personal information to third parties based offshore, we will comply with the requirements of the Privacy Act 2020 that relate to the transfer of personal information offshore.

Behavioural Remarketing

Brother may use remarketing services to advertise on third party websites to you after you visited our Website. We manage this through a variety of remarketing services and ad exchanges which use cookies to inform, optimise and serve ads based on your past visits to our Website.

One such remarketing service Brother uses is the Google AdWords remarketing service, provided by Google Inc. The remarketing services we use offer you the opportunity to opt-out of their tracking systems. Legal Proceedings

Though we make every reasonable effort to preserve your privacy, we may need to disclose your personal information if, for example, we believe on reasonable grounds that such action is necessary for the enforcement of a law that imposes a pecuniary penalty or for the conduct of current or reasonably contemplated proceedings before any court or tribunal.

Aggregated Anonymised Information (non-personally identifiable)

We share aggregated anonymised demographic information with our partners and advertisers. For example we may, on a periodic basis, present information such as the number of visitors, areas of interest, relationship to Brother, etc. This is not linked to any personally identifiable information.

4. Links and Third Party Websites

Links Our Internet Sites may contain links to websites operated by Brother’s parent company and its subsidiary companies or selected third party sites. As the content and maintenance of these websites is out of our control, please be aware that Brother is not responsible for the content or privacy practices of such other sites. In cases where third-party plugins, or similar tools, interact with your personal information, be aware that such interactions are also independent of Brother’s control.

In these instances this Privacy Policy will not apply. We encourage you to be aware when they leave our Website and to read the privacy statements of each and every website that you visit. This Privacy Policy applies solely to personal information collected by us.

5. Access and Correction

Accessing and Correcting your Personal Information

You are entitled to receive from us, upon request, confirmation of whether we hold any personal information about you and access to or assistance with accessing your personal information. You are also entitled to request that we correct any inaccuracies in any information which we hold about you. We are entitled to charge you for the reasonable costs of providing assistance or making information available in compliance with a request for access and providing assistance or attaching a statement of correction to personal information in connection with a request for correction.

6. Changes to this Privacy Policy

Notification of Changes

If we decide to change this Privacy Policy, we will post those changes to this Privacy Policy, accessible from the https://www.brother.co.nz home page and other places we deem appropriate. In some cases we may also email you where you have opted to receive communications from us, notifying you of the changes in our Privacy Policy. If you have deleted/deactivated your account, then you will not be contacted.
