Specific Terms and Conditions for On-site Warranty Upgrade Offer
Brother International (NZ) Limited, NZBN 9429040930077 (Brother) is giving eligible customers the ability to add up to an additional 12-month coverage period to their existing On-site Warranty (Upgrade), increasing the total warranty period to five (5) years. Label printers with a 4-year return-to-base warranty are explicitly not eligible for this On-site Warranty Upgrade Offer. An eligible customer will need to accurately complete a product registration and once approved by Brother, will become entitled to the Upgrade. If an eligible customer already has an approved product registration, they will automatically be entitled to the Upgrade.
These specific terms and conditions (Terms) apply to all eligible customers who take up the Upgrade and are to be read in conjunction with Brother’s 4-Year On-site Printer Warranty Scheme (On-site Warranty). Except for the additional warranty time period, these Terms do not affect any other terms and conditions relating to Brother’s existing On-site Warranty, which continue to apply in all respects and will prevail in the event of any inconsistency.
By applying to receive the Upgrade as detailed below, you have agreed to accept these Terms, the On-site Warranty and Brother’s Website Terms and Conditions and Privacy Policy. If you do not agree to be bound by these terms, you must not apply to receive the Upgrade or notify us you do not wish to accept these terms.
How to become eligible for the Upgrade:
- The Upgrade offer opens at 12:00am on 01st December 2023 and continues until such time as Brother determines the Upgrade will finish (Upgrade Period).
- To be an eligible customer for the Upgrade, you must have purchased a Brother Printer within the past five years, and you must meet the Brother Eligibility Criteria, as set out in the On-Site Warranty (except for the On-site Warranty Period of four years). If you do not meet the criteria, you are not eligible to receive the Upgrade. For clarity, the Upgrade does not extend to any Limited 12-month Return-to-Base Warranty (as set out in the On-Site Warranty).
- To apply for the Upgrade, the eligible customer must register their Brother Printer, following the communications/instructions Brother provides, within the Upgrade Period. Eligible customers must complete all required details on the product registration page and may be required to provide sufficient proof of purchase (including date of purchase). By applying for the Upgrade, eligible customers represent and warrant that all information submitted by them is true and complete. The Upgrade will apply automatically to eligible customers who already have an approved product registration within the Upgrade Period.
- Brother reserves the right to make whatever enquiries it sees fit to prove your identity and eligibility. Brother may refuse your application for the Upgrade at its sole discretion, including (but not limited to) if it believes that you are in breach of these Terms or the On-site Warranty.
- Once submitted by the eligible customer, Brother will confirm the validity of the product registration and confirm to eligible customers whether they have qualified for the Upgrade.
Other Terms
- These Terms, including the product registration mechanism and Upgrade Period, may be amended at any time, at Brother’s sole discretion. Brother reserves the right to terminate or extend the Upgrade offer, or an individual eligible customer’s Upgrade, at any time without notice.
- Brother will collect and use personal information collected from you (for example your email address and other contact details) for the purposes of the Upgrade and such personal information will be held in accordance with the Privacy Act 2020, Brother’s Privacy Policy and these Terms. Without limiting the provisions of Brother’s Privacy Policy, such personal information may be shared with other third-party service providers for the purposes of providing the Upgrade or supporting Brother’s promotional, marketing and publicity purposes. You have the right to request access to and correction of your personal information (where such information is readily retrievable) by contacting Brother.
- Except for the consents given above and the completion of product registration, eligible customers are not required to provide any consideration or pay any money to receive the Upgrade. As such, Brother’s decisions on all registrations and the grant of any Upgrade are final and no correspondence will be entered into.
- If any provision of these Terms is held to be invalid, void, unenforceable or illegal for any reason, such provision will be deemed to be severed from these Terms and the remaining provisions will continue in full force.
- If Brother delays or does not exercise any of its rights or remedies under these Terms, that will not be a waiver of the right or remedy.
- These Terms are governed by the laws of New Zealand and subject to the exclusive jurisdiction of the Courts of New Zealand.
