1. The promoter is Brother International (NZ) Limited (Brother). Brother is giving eligible purchasers the ability to book a collection pick up of their old printer and new printer packaging from their nominated residential address for recycling of all materials able to be recycled (Printer Pick Up).
2. These terms and conditions apply to all eligible purchasers who accept the Printer Pick Up service.
Printer Pick Up
3. To be eligible to receive the Printer Pick Up service, the Purchaser must (Eligible Purchaser):
3.1. Comply with these terms and conditions
3.2. Be 18 years of age or older
3.3. Be a New Zealand citizen or resident
3.4. Have purchased a Brother printer hardware from an authorised Brother reseller (Purchased Product)
3.5. Have an Eligible Product defined as like-for-like printer hardware (size dimensions and weight) compared to the Purchased Product
3.6. Have proof of identity and proof of purchase to verify the above criteria
4. Eligible Product may be determined at the discretion of Brother.
5. For the avoidance of doubt, A3 copiers are not an Eligible Product.
6. Upon booking your collection via Brother’s website, when preparing the Eligible Product for the Printer Pick Up service, you agree:
6.1. To accept the service will be performed by a Collection Agent, a third-party courier service contracted to Brother
6.2. The collection will only include printer hardware and Brother packaging materials and further you agree should there be other items found, you as the Eligible Purchaser will be liable for any costs associated with disposing/recycling the other items found
6.3. The total package weight must not exceed 20kg
6.4. Items (maximum two items) to be collected must be appropriately packaged and sealed for safe transportation
7. You warrant that the Eligible Product is unencumbered and you have the appropriate rights and authority in the Eligible Product to instruct its collection, recycling and disposal through the Printer Pick Up service offered by Brother.
General
8. In providing the Printer Pick Up service, Brother is not responsible for any loss or damage caused by events, matters or circumstances beyond its reasonable control or any negligent conduct, or misuse, abuse, neglect or accident by the Eligible Purchaser or the Collection Agent.
9. Printer Pick Up cannot be redeemed in conjunction with Brother’s existing Free Delivery and Installation Promotion as recycling is already included.
10. Brother accepts no responsibility for lost or incomplete Printer Pick Up.
11. These Terms may be amended at any time, at Brother’s sole discretion. Brother reserves the right to terminate or extend the Promotion offer at any time without notice.
12. Brother will collect and use personal information collected from you (for example your email address and other contact details) for the purposes of the Printer Pick Up and such personal information will be held in accordance with the Privacy Act 2020, Brother’s Privacy Policy and these Terms. Without limiting the provisions of Brother’s Privacy Policy, such personal information may be shared with other third party service providers for the purposes of providing the Printer Pick Up. You have the right to request access to and correction of your personal information (where such information is readily retrievable) by contacting Brother.
13. Except for the consents given above and the completion of the booking, Eligible Purchasers are not required to provide any consideration or pay any money to receive the Printer Pick Up service. As such, Brother’s decisions on all Printer Pick Ups are final and no correspondence will be entered into.
14. If any provision of these Terms is held to be invalid, void, unenforceable or illegal for any reason, such provision will be deemed to be severed from these Terms and the remaining provisions will continue in full force.
15. If Brother delays or does not exercise any of its rights or remedies under these Terms, that will not be a waiver of the right or remedy.
16. These Terms are governed by the laws of New Zealand and subject to the non-exclusive jurisdiction of the Courts of New Zealand.
