Terms and Conditions

Brother International (NZ) Limited is the authorised New Zealand distributor of Brother Sewing and Craft Machines and is referred to in these Terms and Conditions as Brother or us or we.

This warranty covers all newly purchased Brother Sewing and Craft Machines provided that they are used for commercial or business purposes. If you purchase a Brother Sewing or Craft Machine and use that machine for domestic or household use, that machine is not covered under this warranty, but may be covered under the Brother Sewing and Craft Consumer Warranty (the terms and conditions of which can be found online at https://www.brother.co.nz/sewing-craft-warranty-terms).

Standard 1 Year Return to Base Warranty

Subject to these Terms and Conditions we warrant that your Brother Sewing or Craft Machine will be free from defects in manufacturing and materials under normal use for 1 year from the date of purchase from a Brother authorised retailer or reseller (proof of purchase is required).

How to Claim under this Warranty

In the unlikely event that the machine you have purchased has a defect or is not operating as it should, please call our NZ-based Helpdesk between the hours of 8:30am to 5:00pm, Monday to Friday on 0800 329 111 or view sewing FAQs here and ScanNCut FAQs here. User manuals can be found here.

Your Brother NZ Helpdesk representative will:

  • attempt to help resolve your issue by consultation; and
  • if not able to be resolved by consultation, provide you with the details of your nearest Brother Authorised Technical Service Provider.

 

You may also, with valid proof of purchase, return to your place of purchase who will arrange for your machine to be repaired by a Brother Authorised Technical Service Provider.

Additional charges

Any charges not covered by this warranty will be advised to you prior to repair.

Transport

Your Sewing and Craft Machine must only be transported in packaging supplied, or approved, by Brother.

Where the original packaging has not been retained, you may obtain packaging from Brother (Spare Packaging) at an additional cost to you. Any Spare Packaging supplied must be returned to Brother promptly following return of your Sewing and Craft Machine.

Onsite or call-out

If an onsite service visit is required, travel (such as where the service location is more than 30km from an Approved Brother Service Technician) or call-out charges may apply.

Loan Machines

Where the supply of parts delays the repair of your Sewing and Craft Machine, we may (at our sole discretion) provide you with a Loan Machine (Loan Machine), subject to the terms and conditions of this Loan Machines clause.

If you have been provided a “Loan Machine” the following applies:

  • You are responsible for the safe and proper use of the Loan Machine and risk in the Loan Machine sits with you until it is returned to Brother.
  • The Loan Machine must be returned to Brother as soon as your repaired Sewing and Craft Machine is returned to you or otherwise no later than one year after the date it is provided to you.
  • Improper use, resulting in damage or failure to return the Loan Machine, may result in the Loan Machine being invoiced to you.

 

What this Warranty Does Not Cover

There are a few things this warranty does not cover, and these include (but are not limited to):

  • Replacement of accessories and consumable items, which occasionally require replacement, and maintenance kits.
  • Damage caused by accident, neglect, misuse, abuse, improper installation or operation, acts of God (unpreventable event caused by the forces of nature), foreign matter entering the product such as liquid, moisture, insect infestation or dirt.
  • Damage caused from service, maintenance, modification or tampering by anyone other than a Brother Authorised Service Technician.
  • Damage caused by the improper use of non-Genuine1 Brother Products.
  • Using the machine other than for its intended purpose or in a manner contrary to any product manuals or instructions. For example, use on electrical voltages other than shown on the rating plate, or use with the serial number or rate label removed.
  • Damage to the Sewing and Craft Machine in transit to the extent caused or contributed to by inadequate or unapproved packaging.
  • Machinery purchases outside of New Zealand.
  • Any compensation or remedy other than the compensation and/or remedies set out in the section titled ‘How to Claim under this Warranty’.
  • Any indirect, incidental or consequential loss, cost or damage to an Eligible Customer (including but not limited to loss of revenue, loss of profit, loss of opportunity, loss of goodwill and wasted time).

 

You acknowledge that the Brother Sewing and Craft Machine you have purchased is being used for commercial or business purposes and therefore the Consumer Guarantees Act 1993 does not apply to your Brother Sewing or Craft Machine. You also acknowledge that no other warranties either express or implied by law are made with respect to this Sewing and Craft Machine.

Recommended Servicing

Servicing your machine regularly helps to maintain optimum performance. We recommend that your Brother Sewing and Craft Machine be serviced a minimum of once every 6 months, depending on usage. If you need help finding an Approved Brother Service Technician, please contact our NZ based Helpdesk on 0800 329 111 during the times specified in the “How to Claim Under this Warranty” section.

General Conditions

Brother reserve the right to refuse any claim under these Terms and Conditions should we determine that you are not a bona fide claimant, have provided us with false or misleading information, or that you otherwise do not meet the criteria set out in these Terms and Conditions. You must respond to Brother’s reasonable requests for information so that Brother can assess the validity of any claim under this Warranty.

Brother is not liable for any loss, damage or injury of any nature however caused or sustained by you or any other person in connection with any act or omission of Brother under or in connection with these Terms and Conditions.

These Terms and Conditions are governed by New Zealand law.

1 Genuine Brother Products are products manufactured by or at the order of Brother for use with Brother Sewing or Craft Machines. Genuine Brother Products will bear the Brother logo on their packaging.
