General Terms and Conditions relating to Giveaways and Competitions

1. General

1.1 The promoter is Brother International (NZ) Limited (Brother).

1.2 These Terms and Conditions apply to all giveaways and competitions Brother may promote or offer from time to time (Promotions). For the avoidance of doubt, these Terms and Conditions apply to giveaways and competitions and not to product promotions and deals or to Brother’s Special Reward Programme for commercial partners, each of which are subject to separate terms and conditions that may be found at

1.3 Each Promotion will provide for certain terms specific to that Promotion in its relevant flyer or other promotional materials (Specific Terms). To the extent of any inconsistency or conflict between those Specific Terms and these Terms and Conditions, the Specific Terms will prevail. In any circumstance, Brother offers any Promotion in its sole discretion and without requiring specific consideration to be provided by participants or winners. Accordingly, Brother’s decision on all matters related to the Promotion, including eligibility is final and is at Brother’s sole discretion.

1.4 The relevant prize, reward, or benefits associated with any Promotion will be specified in the Specific Terms (Reward). A Promotion may have one or more Rewards.

1.5 Each Promotion may include specific eligibility criteria in the Specific Terms. Unless stated otherwise in those Specific Terms, to be eligible to enter any Promotion you must:
(a) comply with these Terms and Conditions;
(b) be 18 years of age or older;
(c) be a New Zealand citizen or resident.

1.6 Brother reserves the right to exclude any person from participating in a Promotion for any reason.

1.7 By applying to participate in any Promotion, you agree to be bound by these Terms and Conditions and any Specific Terms.

1.8 Where a Reward involve goods or services supplied by third parties who Brother does not control, you acknowledge that any such third party goods or services are governed by that third party’s terms and conditions and Brother is not responsible for the availability or quality of any third party goods or services after granting a Reward.

1.9 If you are asked to provide personal information to enter or participate in a Promotion, you consent to us using your personal information for our own business purposes without any payment or other compensation (which may include using or publishing your name or image in our promotional materials, advertising or via our online and social media platforms) and the uses contemplated by our privacy policy.

1.10 Only one entry per person unless varied by Specific Terms.  

1.11 Brother accepts no responsibility for lost or incomplete entries.

1.12 Brother accepts no responsibility for the cost or safe return of any participant’s garment, artwork or other creation.

1.13 Brother reserves the right to amend, vary, extend or discontinue any Promotion at any stage, for any reason. 

1.14 Each Promotion and these Terms and Conditions is governed by and must be construed in accordance with the laws of New Zealand.  You agree and submit to the exclusive jurisdiction of the New Zealand Courts.

2. Receiving your Reward

2.1 Only the person who originally entered the Promotion can receive a Reward (a Winner). 

2.2 A Winner will be determined in the manner set out in the Specific Terms – if not specified, then as determined by Brother at its discretion.

2.3 Each Winner will be notified at the phone or email provided to Brother on entry or sign-up.  If a Winner cannot be contacted within a reasonable time, Brother reserves the right to reallocate the Reward to another participant.

2.4 Rewards are not redeemable for cash or transferable. Unless otherwise stated, no other family members, friends, office associates or other persons may participate on the Winner’s behalf. In the event that a Reward specified in the Promotion becomes unavailable for any reason, Brother may elect to substitute a prize of like or equal value. 

2.5 Each Winner takes Rewards entirely at their own risk and indemnifies Brother in respect of any claim for any accident, injury, property damage or loss of life that may occur in connection with use or enjoyment of the Reward.
